This Testimonials Disclosure (“Disclosure”) is issued by Restore MyoHealth LLC DBA Restore MyoHealth Myofunctional Therapy (“Company,” “we,” “us,” or “our”) and governs the publication, interpretation, and legal use of any client feedback, reviews, success stories, endorsements, or results-based testimonials (collectively, “Testimonials”) displayed on the website located at www.restoremyohealth.com (the “Site”) or shared via Company advertisements, social media, email marketing, sales pages, or digital content (collectively, “Materials”).
By viewing or relying upon any Testimonial featured in our Materials, you agree to the terms of this Disclosure.
I. INDIVIDUAL EXPERIENCES ONLY — NOT GUARANTEES
1.1 Results Vary Widely.
All Testimonials represent the genuine, individual experiences and personal opinions of the person or entity featured. These Testimonials:
- Are not intended to represent typical or guaranteed results;
- Do not constitute a promise or prediction of outcomes;
- Are specific to each individual’s effort, industry, skill level, and circumstances.
You understand that your results will vary, and that no testimonial may be reasonably construed as a claim of guaranteed earnings, success, or performance.
II. FTC-COMPLIANT AFFIRMATIONS
2.1 Voluntary Submissions.
Unless explicitly stated, Testimonials used by the Company were:
- Provided voluntarily without compensation;
- Submitted by real individuals with direct experience with our products or services;
- Approved for publication either in writing or through implied permission (e.g., tagged social content or public reviews).
2.2 Paid Endorsements (If Applicable).
If compensation, incentives, discounts, or affiliate partnerships were involved in the submission of any Testimonial, such relationships will be clearly and conspicuously disclosed adjacent to the statement or listing.
We strictly adhere to the Federal Trade Commission’s Guidelines on Endorsements and Testimonials under 16 CFR Part 255 and ensure that no material connection is concealed from the user.
III. MODERATION AND EDITING RIGHTS
3.1 Edits for Clarity.
Testimonials may be edited for:
- Grammar, length, or clarity
- Removal of personally identifiable or sensitive information
- Formatting consistency across platforms
However, no edits will alter the substance or intended meaning of the original statement without the submitter’s written approval.
3.2 Removal or Rejection.
The Company reserves the right to:
- Decline to publish any Testimonial that we believe is false, misleading, defamatory, discriminatory, or unlawful;
- Remove Testimonials at any time without notice;
- Request additional documentation to verify results or claims.
IV. PLATFORM REPRESENTATIONS
4.1 Not Verified by Third Parties.
Unless explicitly stated, Testimonials presented on the Site or in our Materials:
- Have not been independently verified by third-party organizations, platforms, or regulatory agencies;
- Reflect personal experiences, not scientific evidence or empirical studies;
- Are based on use of Company products/services under varying conditions that may not apply to your unique context.
V. USER RESPONSIBILITY & DUE DILIGENCE
You agree and acknowledge that:
- Reliance on any Testimonial is undertaken at your own risk;
- You are solely responsible for evaluating the appropriateness of any claim, recommendation, or suggestion before acting upon it;
- No Testimonial constitutes professional advice, legal direction, or financial instruction.
Before purchasing any product, service, or implementing any strategy described in a Testimonial, you are encouraged to perform your own due diligence or consult with licensed professionals.
VI. INTELLECTUAL PROPERTY & LICENSE TO USE TESTIMONIALS
6.1 Permission to Publish.
If you submit a Testimonial (written, video, or visual) or tag us on social media platforms, you grant the Company a worldwide, irrevocable, perpetual, royalty-free license to:
- Publish, reproduce, adapt, edit, and display your Testimonial in marketing materials;
- Use your name, photo, likeness, social handle, or first name + last initial for attribution (unless anonymity is requested in writing);
- Feature the content in advertisements, social media posts, web pages, sales materials, and digital products.
No compensation will be owed unless a separate agreement is entered into in writing.
